If the law requires that a marriage license from the marriage is filed with the court before a divorce can be granted and the court grants the divorce anyway, it's not really legal because the marriage license wasn't filed. If Mary Smith relies on that and gets married again, her 2nd marriage isn't legal. You can petition the court to be allowed to file the marriage license late and have the divorce be granted again retroactive to the date it was supposed to be done in the first place.
